Terms and Conditions
These terms govern business use of Bookly. By creating an account or purchasing a plan, you agree to them on behalf of yourself or your organization.
1. The service
Bookly is a software service operated by SRL Automation Factory that helps service businesses manage schedules, staff, services, customers and appointments and provide public booking links (the “Service”). Features and limits depend on the selected plan.
Bookly provides technology only. The business shown on a booking page is solely responsible for its services, prices, availability, staff, consumer information, cancellations, refunds and relationship with the person making the booking. Bookly is not a party to the service contract between them.
2. Accounts and authorized use
You must be at least 18 years old and able to enter into a binding contract. You must provide accurate information, keep login credentials secure and promptly notify us of unauthorized access. You are responsible for activity under your account and for users you authorize.
You may use the Service only for lawful business purposes. You must not misuse the Service, interfere with its security, access it without authorization, upload malware, infringe rights, send unlawful communications, process data without a legal basis, or reverse engineer or resell the Service except with our written permission.
3. Customer data and privacy
You retain rights in data you submit to Bookly. You grant Bookly the limited right to host, copy, transmit and otherwise process that data to provide, secure and support the Service.
You are responsible for the legality, accuracy and content of customer and staff data, for required notices and consents, and for responding to individuals’ rights. Do not enter sensitive data unless it is necessary, lawful and appropriately protected. Our Privacy Policy explains Bookly’s processing.
4. Plans, payment and cancellation
Prices, billing periods and plan limits are shown at checkout or on the website. Subscription payments are processed by Lemon Squeezy, which may act as merchant of record and apply its own checkout terms. Taxes may be added where required.
Subscriptions renew automatically for the selected billing period unless cancelled before renewal. You can cancel at any time; cancellation takes effect at the end of the paid period. Except where mandatory law requires otherwise or checkout terms expressly provide otherwise, amounts already paid are non-refundable. We may change future pricing or plan features with reasonable advance notice.
5. Availability and changes
We aim to keep Bookly available and secure but do not guarantee uninterrupted or error-free operation. Maintenance, third-party services, network failures or security events may affect availability.
We may improve, change or discontinue features, provided that we do not materially reduce a paid plan during its current billing period without a reasonable remedy.
6. Intellectual property
Bookly and its software, design, trademarks and content belong to us or our licensors. These terms grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription.
Feedback may be used by us without restriction or payment, provided it does not identify you or disclose confidential information.
7. Suspension and termination
You may stop using Bookly or cancel your subscription at any time. We may suspend or terminate access for material breach, non-payment, unlawful use, security risk or where required by law. Where practical, we will give notice and an opportunity to remedy the issue.
After termination, access ends and data may be deleted after a reasonable period, subject to legal retention and backup cycles. Export important data before termination. Provisions that by nature should survive termination remain effective.
8. Disclaimers and liability
To the extent permitted by law, the Service is provided “as is” and “as available”. We disclaim implied warranties that may lawfully be excluded. Bookly is not responsible for services provided by business customers, customer no-shows, lost revenue, user content, third-party integrations or events outside our reasonable control.
To the extent permitted by law, neither party is liable for indirect, incidental, special or consequential loss, lost profits or lost data. Bookly’s total liability arising from the Service will not exceed the fees you paid for the Service during the 12 months before the event giving rise to the claim.
These limits do not apply where liability cannot lawfully be limited, including for fraud or intentional misconduct.
9. Governing law and disputes
These terms are governed by the laws of the Republic of Moldova, without regard to conflict-of-law rules. The parties will first try in good faith to resolve a dispute by contacting each other.
If unresolved, the courts of the Republic of Moldova have jurisdiction, except where mandatory consumer law requires otherwise.
10. Changes and contact
We may update these terms. The current version and effective date will be posted on the website. Material changes will be notified in advance where reasonably possible. Continued use after the effective date constitutes acceptance, unless the law requires separate consent.
